Contracts & GDPR
The entry into force of the General Data Protection Regulation obliges organisations to review the entirety of the statements relating to personal data in their contracts and various legal notices in order to comply with the principles of personal data protection.
Several new statements must be inserted in order to comply with the GDPR model concerning the underlying data processing, such as the legal basis of the processing, the existence of a transfer outside the EU or the exercise of the rights of data subjects.
This is a real problem for companies and their Data Protection Officers who have to comply with a still recent GDPR and manage all these changes themselves or with the help of a specialised law firm, under the watchful eye of the CNIL.
It is a question of really framing the principles of personal data protection when personal data processing is involved, all the more so when it is a question of processing sensitive data.
